The case, filed by James Rudd, a builder from Lancaster, who was seeking to claim back GBP3,000, was dismissed as the county judge deemed the case inadequate, This Is Money reported.

Cited in the BBC, Judge Forrester, who ruled on the case, said: It is ordered that the particulars of claim are struck out as disclosing no reasonable grounds for bringing the claim set out as a coherent set of facts, which if true, disclose a legally recognizable claim against the defendant.

Mr Rudd himself has also reportedly admitted that the paperwork for the case may not have been adequate enough.

Lloyds TSB also won a similar case earlier this month, when the Birmingham County Court dismissed a claim for GBP2,545 from Kevin Berwick, who argued that the overdraft charges were illegal, reported This Is Money.

According to the financial news site, there may be more than a million people considering reclaiming bank charges. Many have already been successful with banks settling before facing a judge.
